Cognizant sues Infosys over trade secrets in US

BENGALURU: Cognizant has filed a lawsuit against Infosys in the US, alleging that the latter stole proprietary information related to its health tech subsidiary TriZetto.
According to the complaint, Infosys accessed TriZetto’s proprietary software offerings and related technical documentation under the guise of non-disclosure and access agreements (NDAAs) that it executed with TriZetto.These agreements were meant to allow Infosys to complete work for certain clients who were also customers of TriZetto. Cognizant acquired healthcare tech firm TriZetto for $2.7 billion in 2014.
TriZetto has sought a jury trial and is seeking a preliminary and/or permanent injunction to prohibit Infosys and its associates from using or possessing TriZetto’s trade secret information. Additionally, TriZetto has asked for restitution in an amount to be determined at trial.
“Yet, in contravention of those agreements, Infosys has misappropriated TriZetto’s trade secrets and stolen its confidential information to develop or enhance its own competing software and service offerings for its own financial gain, thus causing severe and irreparable harm to TriZetto,” the complaint said.
The complaint also alleges that Infosys breached its obligations under the customer NDAA and unlawfully exploited its access through at least one employee located in Richardson to misappropriate TriZetto’s trade secrets. An email sent to Cognizant didn’t elicit a response till the time of going to press.
Infosys said it is aware of the lawsuit. “We deny all allegations and will defend our position in court,” it said in a statement. Over the past decade, Infosys has signed at least seven NDAAs with TriZetto, acknowledging TriZetto as the sole owner of its confidential information.
